Our terms and conditions

1. Introduction

These Terms of Service ("Terms") govern your use of Montenegro.com ("Platform", "we", "us"), a vacation rental marketplace operated by Montenegro.com d.o.o., registered in Montenegro. By accessing or using the Platform, you agree to be bound by these Terms.

2. Definitions

  • Host: A user who lists a property for short-term rental on the Platform.
  • Guest: A user who books accommodation through the Platform.
  • Listing: A property advertised for short-term rental on the Platform.
  • Booking: A confirmed reservation between a Guest and a Host.
  • Service Fee: The commission charged by the Platform, currently 8% of the booking total, paid by the Host.

3. Account Registration

To use certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information and to update it as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Listings and Host Obligations

Hosts are responsible for:

  • Providing accurate descriptions, photographs, and pricing for their Listings.
  • Maintaining the property in a safe and habitable condition consistent with the Listing description.
  • Complying with all local laws, including tourism registration, tax obligations, and building safety regulations in Montenegro.
  • Responding to booking inquiries within 48 hours.
  • Honouring confirmed Bookings unless cancellation is permitted under the applicable Cancellation Policy.

5. Bookings and Guest Obligations

Guests agree to:

  • Provide accurate information when making a Booking, including the number of guests and purpose of stay.
  • Treat the property with care and respect house rules set by the Host.
  • Report any damage or issues to the Host promptly during the stay.
  • Vacate the property by the agreed check-out time.

6. Payments

All payments are processed through our payment partner, Stripe. When a Guest makes a Booking, the full amount is charged at the time of confirmation. The Platform deducts the Service Fee (8%) and remits the remainder to the Host within 24 hours of the Guest's check-in date.

Prices are displayed in Euros (EUR). The Guest is responsible for any currency conversion fees charged by their bank or payment provider.

7. Cancellation Policies

Each Listing specifies one of the following cancellation policies:

  • Flexible: Full refund if cancelled at least 24 hours before check-in.
  • Moderate: Full refund if cancelled at least 5 days before check-in.
  • Strict: 50% refund if cancelled at least 7 days before check-in.
  • Super Strict: No refund after confirmation.

The Service Fee is non-refundable. In cases of force majeure (natural disaster, government travel restrictions, pandemic), we may issue refunds at our discretion.

8. Security Deposits

Hosts may require a security deposit, which is held via Stripe and released within 7 days after checkout unless a damage claim is filed. Disputes regarding security deposits are resolved through our Dispute Resolution process.

9. Reviews

Both Hosts and Guests may leave reviews after a completed stay. Reviews must be honest, relevant, and not contain hate speech, discrimination, or personal attacks. We reserve the right to remove reviews that violate these standards.

10. Prohibited Activities

You may not:

  • Use the Platform for any illegal purpose.
  • Post false, misleading, or fraudulent Listings or reviews.
  • Circumvent the Platform's payment system to avoid Service Fees.
  • Harass, threaten, or discriminate against other users.
  • Scrape, crawl, or use automated means to access the Platform without written permission.
  • Sublease a property booked through the Platform without the Host's written consent.

11. Intellectual Property

All content on the Platform (text, design, logos, software) is owned by Montenegro.com d.o.o. or its licensors. By uploading content (photos, descriptions), you grant us a non-exclusive, worldwide licence to use, display, and distribute that content in connection with the Platform.

12. Limitation of Liability

Montenegro.com acts as a marketplace connecting Hosts and Guests. We do not own, manage, or control any listed properties. To the maximum extent permitted by law:

  • We are not liable for the condition, safety, or legality of any Listing.
  • We are not liable for the actions or omissions of Hosts or Guests.
  • Our total liability to you for any claim arising from your use of the Platform is limited to the amount of Service Fees you have paid in the 12 months preceding the claim.

13. Dispute Resolution

If a dispute arises between a Host and a Guest, we encourage both parties to resolve it directly. If resolution is not possible, either party may escalate the dispute to our support team. We will review the evidence and issue a resolution within 14 business days.

Any legal disputes arising from these Terms shall be governed by the laws of Montenegro and subject to the exclusive jurisdiction of the courts in Podgorica, Montenegro.

14. Account Termination

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or receive repeated verified complaints. You may close your account at any time through your account settings, subject to any pending Bookings or outstanding payments.

15. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email at least 30 days before they take effect. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
